  2.      BOOKING AGENCY AGREEMENT

  5.      THIS CONTRACT, entered into on this __th day of ________, 19__, is
  6. for the personal services of the Musician(s) for the performance described 
  7. below.  The undersigned employer and the undersigned musician(s) agree and
  8. contract as follows:

  30. 10.  This contract constitutes a complete and binding agreement between the 
  31. employer and the musician(s).  AGENT acts only as agent and assumes no 
  32. responsibility as between the employer and the musician(s).

  34. 11.  The musician(s) jointly and severally, agree to pay AGENT a booking 
  35. commission within five days after the performance:

  44. 12.   The musician(s), jointly and severally, agree to book all return 
  45. performances from the undersigned employer for a period of one year (from 
  46. the date in Section 4) through AGENT, for the same percentage stated in 
  47. Section 11 of this contract.

  49. 13.    In case of breach of this contract by Employer, the Employer agrees 
  50. to pay the amount stated in Section 6 as mitigated damages, plus reasonable 
  51. attorney's fees, court costs, and legal interest.
  52.  
  53. 14.    The Employer agrees to be responsible for harm, loss, or damage of 
  54. any kind to musician(s) person or property while located at the place of 
  55. performance (Section 3 herein).
  56.  
  57. 15.     The persons signing for Employer and the Musician(s) agree to be 
  58. personally, jointly and severally liable for the terms of this contract.
